Mira Road police file suo moto FIR against hate monger Kajal Hindustani; no arrest yet

This FIR is pertaining to a speech that had caused furore among the locals and other citizens, making Kajal a notorious hate offender

Another FIR has been filed against Kajal Shingala aka Kajal Hindustani, on April 24, for her most vitriolic speech, due to which she had gained publicity in the first place. This was delivered in the Mira Road area of Mumbai suburbs in front of over 1,500 people at the Hindu Jan Aakrosh Morcha event on March 12. She has been booked under sections 153A [promoting enmity between different groups etc]and 505(2) [Statements creating or promoting enmity, hatred or ill-will between classes] of the IPC

In this speech, Kajal made Islamophobic comments like, “I am seeing that Hindus have left Mira Bhayandar and Jihadis have usurped and captured this area.” She highlighted 3 main factors of Islamic encroachments: 1. Love Jihad 2. Illegal Muslim encroachment and 3. religious conversion. She even called Hindus impotent for not taking up violence. She used derogatory words like ‘Fatherwala’ and ‘Chadarwala’ as well, among other things.

The speech had caused ripples in the peace-loving residents of the area who had organised a campaign uniquely called ‘#GetWellSoonGeetaJain’ for which the local MLA Geeta Jain had also attended the events where Kajal spoke. The protestors had printed postcards with slogans and the local MLA’s address and were requesting common citizens to add their names and signatures to it. The citizens were against the vitriolic hate speech made by Kajal. However, this campaign was disrupted by the police saying that the MLA;s name cannot be used in the protest. On being asked why, the police reportedly told the organisers that they will not be able to prevent any ‘untoward’ incident from happening if the MLA’s supporters turn up.

The following day, a delegation of citizens and representatives of political parties including the CPI (M), AAP and Shiv Sena(UBT) met the Mira-Bhayandar Vasai Virar police commissioner with a letter listing elements from the vicious hate speech and requested him to take action against Kajal and others. Madhukar Pandey, the Commissioner of Police, had assured the delegation that the event was recorded and also assured them that action will be taken soon.

This FIR appears to have followed this meeting of the delegation as this is a suo moto action by Mira-road police. The FIR has been filed by Havaldar Ranjit Bange. In the FIR it has been stated that the rally was carried out from Golden nest circle to Salasar Central Park ground and culminated there around 11.30 am. It is stated that workers of Vishwa Hindu Parishad (VHP), Bajrang Dal, RSS, Hindu Jagran Manch, Hindu Rastra Sena etc participated in this rally.

The FIR details what Kajal Hindustani spoke about  including Land Jihad, Love Jihad, how to protect Hindu religion, how Muslim men trick Hindu girls through movies, social media into drugs and love jihad and how Hindus should beware of such things.  The FIR calls this speech objectionable and quotes some extracts from the speech as well, including her calls for economic boycott of ‘jihadis’. The FIR states that the speech intended to create enmity, hatred between religions and was detrimental to communal harmony.

On Monday as well an FIR was filed against Kajal at Vashi Police station, Navi Mumbai for her speech at Jan Akrosh Morcha held on February 26. She was booked under section 153A (promoting enmity between groups on grounds of religion, race, language, etc.), 153 B (Imputations, assertions prejudicial to national integration), 295A (acts, intended to outrage religious feelings), and 505 (statements conducing to public mischief) of the Indian Penal Code (IPC).

On April 13, a Gujarat court had granted bail to Hindustani, who had been sent to judicial custody for 14 days for allegedly delivering a hate speech during the Ram Navami celebrations that led to communal clashes in Gujarat’s Una on April 1. She was arrested on April 9 after she surrendered to Una Police.

However, after her bail, two more FIRs are against her but neither Vashi Police nor Mira Road police have proceeded to arrest her.
